Terms & Conditions
Welcome to TK Auto Maintenance (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern all mobile automotive maintenance, diagnostic, and repair services provided to you (the “Customer”, “you”, or “your”). By booking an appointment, paying a deposit, or authorizing us to perform work on your vehicle, you agree to be legally bound by these Terms.
1. Scope of Services & Estimates
• Authorization to Work: You authorize our technicians to perform the diagnostic, maintenance, or repair services outlined in your service estimate.
• Variances in Estimates: Pursuant to Georgia consumer guidelines, any quote provided is an estimate based on initial information. If our technicians discover additional necessary repairs or parts requirements upon physical inspection, we will halt work and seek your explicit approval (via text, email, or verbal confirmation) before proceeding with extra costs.
2. Fees, and Payment Terms
• Parts Deposits: For repairs requiring specialized, non-stock, or high-value parts, you must pay a parts deposit covering 100% of the parts cost before the items are ordered. Parts deposits are completely non-refundable once the parts have been ordered from the distributor.
• Accepted Payment Methods: Final payment for the remaining invoice balance is due immediately upon completion of services and before the mechanic departs the worksite. We accept:
• Credit/Debit Card: Paid securely via the electronic text link sent by our invoicing system.
• Zelle / Venmo: Sent directly to our official business handle provided by the mechanic.
• Cash: Exact change is preferred; our mobile mechanics do not carry large amounts of cash for change.
• Non-Payment and Georgia Lien Rights: Failure to pay the remaining balance immediately constitutes a breach of contract. Pursuant to Official Code of Georgia Annotated (O.C.G.A.) § 44-14-363 (Mechanic’s Liens), we reserve the right to retain possession of the vehicle, or file a legal lien against the vehicle for the unpaid balance, plus any associated storage fees, administrative costs, and collection fees.
3. Worksite Safety, Accessibility, and Weather Conditions
• Safe Worksite Requirement: You are solely responsible for providing a safe, flat, and legally accessible environment for our mechanics to work.
• Permissible Surfaces: Vehicles must be parked on a level concrete or asphalt surface (such as a private driveway or designated parking lot stall).
• Prohibited Areas: Services will not be performed on sloped inclines, loose gravel, dirt, mud, or busy public streets/thoroughfares.
• Property Permission: You warrant that you own the property or have explicit legal permission from the property owner/landlord for automotive repair work to be conducted on-site. You assume all liability for property damage or fines resulting from the service location.
• Right to Refuse Service: The mechanic reserves the right to immediately cancel or suspend services if they determine, in their sole discretion, that the worksite is unsafe, hostile, or non-compliant.
• Weather Delays: In the event of rain, lightning, high winds, extreme temperatures, or other hazardous weather conditions, we reserve the right to suspend or reschedule your appointment to ensure technician safety and protect open vehicle components.
• Vehicle Accessibility and Keys: You must ensure the vehicle is completely unlocked and the keys/key fobs are made available to the mechanic at the start of the scheduled service window. If you choose to not be on site during servicing, we ask that you leave your key/key fob somewhere on or around the vehicle with ease of access for the technician & to leave detailed instructions on where to find it.
4. Warranties and Limitation of Liability
• Service and Labor Warranty: We provide a limited warranty on labor for 12 Weeks / 84 Days or 5,000 Miles from the date of service, whichever occurs first (the "Warranty Period").
• Parts Warranty: We do not manufacture automotive parts. Any parts installed during service are backed solely by the manufacturer’s or distributor’s warranty. If a part fails within the manufacturer's warranty period, we will assist you with the exchange, but standard mobile labor fees apply for re-installation.
• Customer-Supplied Parts: We offer no warranty or liability coverage whatsoever on labor or performance for parts provided by the customer. If a customer-supplied part is defective or fails, the customer is responsible for the full labor cost of both the initial installation and any subsequent removal or replacement.
• Warranty Exclusions: This limited warranty is strictly void if the vehicle has been subjected to misuse, neglect, racing, commercial use (e.g., rideshare or delivery), accident, or if the repaired component has been modified or tampered with by the customer or any third party after our service.
• Pre-Existing Conditions and Brittle Components: You acknowledge that older, high-mileage, or poorly maintained vehicles often have brittle, rusted, or degraded components (such as plastic clips, rotted hoses, or seized bolts). The mechanic will exercise reasonable care, but we assume no liability for the failure, breakage, or stripping of surrounding, pre-existing components during a standard repair & additional parts may need to be ordered.
• Limitation of Liability: To the maximum extent permitted by Georgia law, our total liability for any claim, loss, damage, or injury arising out of our services—whether in contract, tort, or negligence—shall be strictly limited to the total dollar amount paid by you for the specific service causing the dispute. In no event shall we be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to towing fees, rental car costs, lost wages, or loss of vehicle use.
5. Governing Law and Disputes
• These Terms shall be governed by and construed in accordance with the laws of the State of Georgia. Any legal action or dispute arising from our services must be filed in the courts of Barrow County, Georgia.
BY PAYING THE BOOKING DEPOSIT OR AUTHORIZING WORK TO BEGIN, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS STATED ABOVE.
